Videotaping a person without permission is illegal, and it could warrant a lawsuit, according to the Houston Chronicle. Permission must be sought before recording someone, and this pertains to interviews.

Russia Today mentions that citizens are allowed to film the police under the First Amendment, but some citizens are being charged with violating wiretapping laws by various states. For instance, Massachusetts law states that police may be recorded as long as the officer is aware of the recording. However, the First U.S. Circuit Court of Appeals ruled that citizens cannot be prosecuted by filming police officers who are on duty. The Houston Chronicle mentions that laws also vary by state when it comes to interviews, and more wiretapping laws may apply when children are videotaped. An attorney should be consulted to avoid legal repercussions.
