All that being said, if your using something that actually pulls more then 40 amps, then it is code at that point to use 6 gauge wire on a 50 amp breaker. 6 gauge wire can also be used on a 60 amp breaker and still be ok. You need to check the device your using to know if it wants a 50 or 60 amp breaker.
