Each state has different requirements for the number of questions a person can get wrong and still pass the driver's permit test. In New York, the test taker must answer 14 out of 20 questions correctly, while in California, the test taker must answer 38 out of 46 questions correctly.
There are also differing policies on retaking the test if the test taker fails the first time. In New York, a person can retake the test several times without having to pay again. In California, if a person fails, he has only two more chances to pass the test and must wait at least seven days between attempts.
