In 1980, the maker of All Nighter Stoves, All Nighter Stove Works, was sued by Fisher Stoves. Fisher Stoves alleged that All NIghter Stove Works was guilty of violating common law trademark, creating unfair market competition, misappropriating confidential information and disregarding the Lanham Act. The court found against the plaintiff and dismissed all complaints. Fisher Stoves appealed the decision, believing the court's findings to be unfair.
