New York is one of a few states to mandate disability payment from employers. Employees who are injured or unable to go to work because of a non-work-related illness or injury can apply to receive disability coverage. Applicants must submit claims to insurance providers, who then present information regarding the condition to the New York State Workers' Compensation Board. Compensation to people injured or disabled in a non-work related incident is available because of the New York State Disability Benefits Law.
Although people can claim disabled benefits in New York, there are some restrictions. Payments cannot exceed 50 percent of weekly earnings, and do not cover medical expenses. Additionally, disability payments last only 26 weeks, or half a year. Under New York laws, employers can collect small handling and processing fees in exchange for filing employees' disability claims.
