An uncontested divorce can take anywhere from several months to several years, depending on the factors impacting a couple's divorce proceedings. An uncontested divorce is simply an agreement to divorce without dispute from either spouse, eliminating the need to force compliance from an unwilling party.
If a couple has a prenuptial agreement or other resolution process in place, the divorce proceedings can last a matter of months. However, this is not the case in most marriages. Many times, couples wait until the divorce process begins to come to an agreement about dividing assets, custody, alimony, child support and other significant issues. When this is the case, the negotiation process may take a year or more.
