There are six main factors to consider when identifying or avoiding a wrongful termination, according to Avvo. The first is that the termination should not be linked to any discrimination prohibited by the Equal Employment Opportunity Commission (EEOC). This includes terminations based on national origin, race, religion, sex, age or pregnancy.
The second consideration is that a termination cannot be based on a mental or physical disability or a failure to accommodate a disability, states Avvo. Additionally, the termination shouldn't be a retaliation for legitimate employee action or a violation of public policy, such as a termination for seeking worker's compensation or for utilizing union rights.
Other considerations include making certain that the termination doesn't violate a contract because if it does that can be considered wrongful termination. Also, the reasons for the termination need to be well-documented, explains Avvo.
