OSHA lists certain industries for which maintaining health and safety records of employees is not required. This includes car dealerships, hardware stores and advertising services. Small businesses, or those that employ 10 people or fewer, do not need to keep records either. The White House and Congress also are exempt from OSHA regulations. Nevertheless, even these businesses are required to report to OSHA any workplace incident that results in death or the hospitalization of at least three employees.
