The three-day notice to pay rent or quit is one of several notice types involved in initiating the eviction process. The landlord has the option of serving the three-day notice to pay rent or quit as soon as a tenant falls behind or doesn't pay the full rent amount. A landlord can't simply kick out a tenant for not paying. He must first serve written notice to let the tenant know that he plans to pursue eviction if the past due rent is not paid. The three-day period begins the day after the notice is served to the tenant.
This notice must be in writing and include complete information such as the tenant's name and the property address. The notice also includes the amount of rent owed to get caught up and how the tenant may pay the rent.
If the three days elapses without payment of rent, the tenant does not immediately have to move out.
