All employers of workers in the United States have a complete copy of Form I-9 for each employee available at the time of hire, and employers are responsible for ensuring proper completion of both the employee and employer sections of the form. Workers filling out I-9 must attest positively to their legal right to work in the country and supply employers with the required documentation to prove eligibility. The government tasks the employer with determining if the documentation is genuine and valid.
The U.S. CIS requires completion of Form I-9 for both citizens and non-citizens working in the United States for American employers, and employers should retain the form for one year after the date of termination or three years after the date of hire.
