It is described in its reglamentation as a technical-military organism and an administrative unit of the Presidency of the Republic to facilitate the President's fulfiment of its attributions and functions. So, the EMP is Mexico's Presidential Guard, and also the chief logistical instrument of the President.

It is part of the Mexican Army, and it is always lead by a General. Its leadership is embodied in the Jefatura del Estado Mayor Presidencial, currently lead by General Jesús Javier Castillo Cabrera, who was appointed by President Felipe Calderón.
